MEMBERSHIP RULES & POLICIES AGREEMENT

This Membership Rules & Policies Agreement (the “Agreement”) is entered into by and between Elev8 Golf Club (“Elev8,” “the Club,” or “Facility”) and the Member identified below. By enrolling in membership and accessing the Facility under membership privileges, the Member acknowledges, understands, and agrees to abide by all rules, policies, and responsibilities set forth herein.

1. GENERAL MEMBER CONDUCT REQUIREMENTS

1.1 Members shall conduct themselves in a respectful, professional, and safe manner while on Club premises.

1.2 Members shall comply with all posted rules, verbal instructions, and directives from Elev8 staff.

1.3 Elev8 reserves the right to suspend or terminate membership privileges for violations of this Agreement, misconduct, or actions deemed unsafe or disruptive.

2. FACILITY ACCESS & SAFETY PROVISIONS

2.1 Members use the Facility at their own risk.

2.2 Members must ensure their guests adhere to all Club rules and accept responsibility for guest conduct.

2.3 Children under sixteen (16) must be under direct supervision at all times.

2.4 Equipment shall only be used in designated areas and for its intended purpose.

2.5 Members shall maintain spatial awareness and refrain from swinging clubs outside approved hitting areas.

3. MEMBERSHIP PRIVILEGES & LIMITATIONS

3.1 Membership grants access to the Facility in accordance with the selected membership tier and posted Club access schedules.

3.2 Certain areas or amenities may be limited, closed, or reserved for special events at the Club’s discretion.

3.3 Membership is non-transferable unless expressly authorized by management.

3.4 Members must maintain a valid payment method on file to keep membership benefits active.

4. SIMULATOR BAY USAGE POLICIES

4.1 Members must reserve simulator time in advance and adhere to reservation time limits.

4.2 Only new, clean, unmarked, and unscuffed golf balls may be used.

4.3 Food and beverages must remain outside the hitting and electronic areas.

4.4 Damage caused by negligence, misuse, or failure to follow procedures will be billed to the Member.

5. PUTTING & PRACTICE AREA POLICIES

5.1 Members shall maintain proper pace and respect others using the practice areas.

5.2 Misuse of equipment, running, or unsafe behavior is prohibited.

5.3 All equipment must be returned to its designated location upon completion of use.

6. FITNESS AREA POLICIES

6.1 Use of the fitness area is at the Member’s own risk.

6.2 Proper athletic attire and clean shoes are required.

6.3 Members must wipe down equipment after use.

6.4 Only Elev8-approved trainers may conduct instruction or coaching.

6.5 Dropping weights, horseplay, or misuse of equipment is prohibited.

6.6 Members under sixteen (16) may not use the fitness area.

6.7 All weights and accessories must be re-racked after use.

7. GUEST PRIVILEGES & FEES

7.1 Guest access is permitted in accordance with the current membership plan.

7.2 Members are responsible for ensuring guests follow all rules and policies.

7.3 Guest fees must be paid upon booking.

7.4 Guests must be accompanied by the Member at all times.

7.5 Public access hours and rates apply to non-member guests outside permitted guest access.

UNPAID GUEST POLICY
Bringing an unpaid or unauthorized guest into Elev8 Golf Club will result in the following escalating consequences:

1st Offense
-Formal warning
-Applicable guest fees charged to member’s account

2nd Offense
-30-day membership suspension
-$250 fine

3rd Offense
-Immediate termination of membership
-$1,000 fine
-Member is responsible for paying the remaining balance of all membership dues owed for the contract term

8. MEMBERSHIP BILLING & CANCELLATIONS

8.1 Membership fees are billed automatically on the schedule selected at enrollment.

8.2 Late or failed payments may result in suspension of access until resolved.

8.3 Cancellations must follow the terms outlined in the Membership Agreement and require written notice.

8.4 Refunds are not provided for unused time, missed reservations, or Facility closures beyond Club control.

9. PERSONAL PROPERTY & EQUIPMENT

9.1 Elev8 is not responsible for lost, stolen, or damaged personal items.

9.2 Only approved outside equipment may be brought into the Facility.

9.3 Proper footwear (soft spikes, athletic shoes, or clean sneakers) is required.

10. ALCOHOL POLICY

10.1 Outside alcohol is strictly prohibited.

11. CLEANLINESS, PROPERTY CARE & DAMAGE LIABILITY

11.1 Members shall maintain cleanliness in all areas they use.

11.2 Members agree to be financially responsible for any damage—intentional or accidental—resulting from misuse, negligence, or failure to follow Club rules.

12. PHOTOGRAPHY & MEDIA CONSENT

12.1 Elev8 may capture photos or videos for marketing or promotional purposes within the Facility.

12.2 Members who prefer not to appear in media must notify staff in writing.

13. LIABILITY WAIVER & ASSUMPTION OF RISK

13.1 Members understand that golf, fitness activities, and simulator use carry inherent risks.

13.2 Members voluntarily assume all risks associated with participation and Facility usage.

13.3 Elev8, its staff, owners, and affiliates are not liable for injuries, damages, or losses resulting from normal Facility use, equipment failure not caused by negligence, or failure to follow posted rules.
